These Terms and Conditions (“Terms”) govern your access to and use of HYNC.io (the “Service”), including the website, web application, APIs (if provided), and related features such as profiles, sharing links, community/leaderboards, and notifications.

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use HYNC.io.

2. Scope of the Service

HYNC.io is a fitness and personal tracking platform that allows you to store and visualize activities, measurements, and related data, including sensitive health data and (if enabled) adult-only intimate data. The Service may include optional features such as public profiles, sharing links, leaderboards, and integrations with third-party providers.

The Service may change over time (e.g., new metrics, integrations, or features). We may add, modify, or remove features as needed, including for security and maintenance reasons.

3. Eligibility and age limits

If we learn that an account was created or used in violation of these rules, we may restrict or delete the account.

4. Account registration, security, and responsibility

4.1 Creating an account

To use most features, you need an account. You must provide a valid email address and choose a secure password. You are responsible for keeping your login credentials confidential.

If you use third-party login or connect integrations (e.g., Google login, Strava, Garmin, Fitbit, etc.), you authorize HYNC.IO to receive and store data you permit through those connections. Integrations remain active until you disconnect them. Third-party providers operate under their own terms and privacy policies.

5. Acceptable use and prohibited conduct

You may use HYNC.IO only in compliance with applicable laws and these Terms. You agree not to:

6. User content, privacy settings, and public sharing

6.1 Your content and responsibility

You may submit content to HYNC.IO (e.g., activities, measurements, notes, profile data, images, comments where available). You are responsible for the content you provide and for ensuring you have the rights to share it.

6.2 Public content and indexing

HYNC.IO includes features that allow you to publish content publicly (e.g., base profile, public activities, sharing links, leaderboards). You control visibility through privacy settings. Public content may be accessible without an account and may be indexed and cached by search engines and third parties outside of HYNC.IO.

If you do not want information to be publicly accessible or indexable, keep it private and do not share it publicly or via public links.

6.3 Adult-only / intimate data

Adult-only features (if enabled) are intended for private tracking. You must be 18+ to use them. These features are disabled by default and require explicit activation. You must not publish adult-only intimate data about yourself or others in public areas.

7. Health and safety disclaimer (no medical advice)

HYNC.IO is a tracking and visualization tool. It does not provide medical advice, diagnosis, or treatment. Any analytics, scores, summaries, or insights are informational only. Always seek professional medical advice for health-related decisions.

You are responsible for how you interpret and use your data. If you rely on data from third-party providers (wearables, apps), accuracy is not guaranteed and may vary.

8. Intellectual property

HYNC.IO, including its software, design, and operator-created content, is protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except where permitted by law.

Third-party trademarks, logos, and brand names belong to their respective owners and are used for identification/compatibility purposes only.

9. Availability, maintenance, and changes

We aim to keep HYNC.IO available and secure, but the Service is provided on an “as is” and “as available” basis. We may perform maintenance, updates, or emergency changes that may temporarily affect availability.

We may change, suspend, or discontinue features (in whole or in part), including for security reasons or to improve the platform.

10. Fees and future paid plans

HYNC.IO is currently offered without mandatory fees. We may introduce optional paid plans (e.g., via Stripe) in the future to cover costs or provide additional features. If paid plans are introduced, we will provide clear pricing, billing terms, and cancellation rules before you subscribe.

11. Suspension and termination

We may suspend or terminate access to the Service if you materially breach these Terms, misuse the Service, or if necessary to protect the Service, other users, or our systems (e.g., security incidents, abuse, illegal content).

You may stop using the Service at any time and you can delete your account using the account deletion feature. Account deletion is described in the Privacy Policy (including backup behavior and suppression list safeguards).

12. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect or consequential damages, loss of profits, or loss of data arising from the use of the Service. Nothing in these Terms limits liability for intent or gross negligence where such limitation is not permitted, or for mandatory statutory liability.

Because HYNC.IO processes sensitive personal data, you should use strong account security. You are responsible for securing your credentials and devices. We cannot guarantee that the Service will be uninterrupted, error-free, or free of vulnerabilities.

13. Privacy

Our processing of personal data is described in the Privacy Policy. By using HYNC.IO, you acknowledge that you have read the Privacy Policy.

14. Changes to these Terms

We may update these Terms to reflect changes in the Service, new integrations, security improvements, or legal requirements. We will publish an updated version with a new effective date. If changes materially affect your rights or obligations, we may provide an additional notice within the Service or via email.

15. Governing law and jurisdiction

To the extent permitted by applicable law, these Terms are governed by the laws of Austria, excluding conflict-of-law rules. If you are a consumer in the EU/EEA, mandatory consumer protection laws of your country of residence may also apply.

For disputes, the competent courts in Austria shall apply to the extent legally permissible. If you are a consumer, this does not affect mandatory rules on jurisdiction under applicable consumer law.

16. Miscellaneous

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. The parties will interpret or, where necessary, replace the affected provision in a way that best reflects the original intent, while remaining legally permissible.
